CAAU Baseball Infractions Committee Procedure

  1. The Infractions Committee shall be comprised of a Chairman and two members at large.
  2. Rules / Ethics Infractions are reported to the Infractions Committee Chairman.
    1. The complaints should be in writing. The Chairman may ask the reporting party to provide additional information or evidence before commencing an investigation of the complaint.
    2. The Chairman must determine whether there is a probable cause to believe that an infraction has occurred over which the Infractions Committee has jurisdiction. If there is no probable cause, the Committee Chairman will discuss the complaint, and advise the complaining party.
  3. The Chair shall give written notice of the complaint.
    1. In all cases in which probable cause is found, the Chairman of the Infractions Committee will send a written notice to the accused describing the facts of the complaint, rules which are alleged to have been violated, and procedures that are to be followed during the investigation.
    2. The notice shall advise the accused party that he or she has seven (7) days to submit any evidence that he or she wishes the Committee to consider or otherwise respond to the complaint.
  4. The Committee Chair shall receive the evidence.

    Evidence may be present in writing or by telephone. If evidence is given by telephone, the Chairman will make his own notes of the conversation to be included in the body of evidence.

    The Chairman may interview any additional witnesses and consider new or additional evidence bearing on the case from whatever source.
  5. The Infractions Committee shall conduct a hearing
    1. The Chairman shall distribute copies of all evidence to the committee members. He may include his own report findings from his sources.
    2. The Committee shall consider the evidence, and report their findings to the NCAAU Baseball Chairman. The Infractions Committee shall determine any penalty or penalties as is necessary.
    3. The NCAAU Baseball Chair shall render the decision
      1. The NCAAU Baseball Chair may accept, reject, or modify the Infractions Committee's recommendations.
      2. The Infractions Committee Chair shall notify all affected parties of the findings, any penalties, and the appeal rights.
  6. Penalties
    1. Penalties that may be imposed include, but are not limited to suspension, expulsion, probation, fines, reprimand, warnings, or other limitation or penalties appropriate to the case.
    2. Penalties may be imposed for violations of AAU Baseball rules, ethical policies, or the AAU Code.
  7. Jurisdiction
    1. The NCAAU Baseball Chair has jurisdiction to determine all qualifications, requirementes, or terms necessary for participation in the NCAAU Baseball Program.
    2. Complaints over which the NCAAU Baseball Chair has no jurisdiction may be referred to the North Carolina AAU Association, or the NCAAU Board of Review.
  8. Appeal
    1. Decisions of the NCAAU Baseball Infractions Committee and of its process may be appealed to the NCAAU Board of Review, under procedures set forth in the AAU code.
    2. Petitions for reinstatement or for modification or commutation of penalties shall be made to the NCAAU Board of Review. Penalties are in force unless and until overturned by the NCAAU Board of Review.
